From the Constitution of the United States:
Article 1, section 8: The Congress shall have the power to raise and support Armies. To provide and maintain a Navy. To provide for calling forth the Militia to execute the Laws of the Union, suppress insurections, and repel an invasion. To provide for organizing, arming, and disciplining the Militia, and for governing such part of them as may be employed in the service of the United States, etc.
Under Article 2; section 2: The President shall be commander-in-chief of the Army, Navy, and Militia when called into actual service of the United States.
Amendment #2 states: A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.
Interpretations? The President and Congress has the power to activate the Militias throughout the United States to repel the illegal invasion of this country that is taking place as I type. Keep in mind, with shots fired at the National Guard, border guards killed in the line of duty, and the flow of guns and drugs into the country across the southern border, it would fall under the domain of an armed invasion. An invasion doesn't have to be armed for the Militia to be activated. But since shots have been fired it is an armed invasion. Myself and like-minded individuals would gladly go and protect the borders if we're organized, armed , fed, and paid a fair compensation for doing so. As a Viet Nam War vet, I don't have to be trained, just tell me who we're shooting at.
Amendment #11 states: The Judicial Power of the United States shall not be construed to extend to any suit in law or equity, commenced or prosecuted against one of the United States by citizens of another State or by subjects or citizens of any Foreign State.
Interpretations? The ILLEGAL alien drug smuggler can't sue the United States for the $5 million he and the ACLU want because he is not a citizen and is not granted the same rights as We, the People. The Constitution does not apply to ILLEGAL aliens. They have no civil rights only human rights. One human right is the right to breathe or simply live. Civil rights are guaranteed to CITIZENS of the United States by The Constitution. All the judge has to do is read the Constitution. Lately it's seems the ACLU stands for Alien Civil Liberties Union.
There's nothing American about an ILLEGAL alien drug smuggler.
